Terms of Use

Linkintel, Inc (“we,” “us,” or “our”) operates Promoty. These Terms govern your access to our website, services, and applications (collectively, the “Service”).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

1. Acceptance of terms

By creating an account, accessing, or using Promoty, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. We may modify these Terms at any time, and such modifications will be effective immediately upon posting. Your continued use of the Service after any changes constitutes acceptance of the new Terms.

2. Eligibility

You must be at least 18 years old to use Promoty. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

3. Account registration

To access certain features of the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration.
  • Maintain and promptly update your account information.
  • Keep your password secure and confidential.
  • Accept responsibility for all activities that occur under your account.
  • Notify us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate your account if any information provided is inaccurate, false, or violates these Terms.

4. Use of service

4.1 Permitted use

Promoty provides tools for creating AI-assisted scripts and video content. You may use the Service for lawful purposes in accordance with these Terms.

4.2 Prohibited conduct

You agree not to:

  • Use the Service for any illegal, harmful, or fraudulent purpose.
  • Create content that violates intellectual property rights of others.
  • Generate content that is defamatory, obscene, offensive, or hateful.
  • Create misleading, false, or deceptive content.
  • Harass, abuse, or harm others through the Service.
  • Attempt to bypass or circumvent any usage limits or restrictions.
  • Reverse engineer, decompile, or attempt to extract source code.
  • Use automated systems to access the Service except as expressly permitted.
  • Interfere with or disrupt the Service or servers.
  • Resell or redistribute the Service without authorization.

5. Subscription and payment

5.1 Subscription plans

Promoty offers various subscription plans with different features and usage limits. By subscribing, you agree to pay all fees associated with your chosen plan.

5.2 Billing

Subscription fees are billed in advance on a recurring basis (monthly or annually). Payments are processed securely through Stripe, our payment provider. You authorize Stripe to charge your payment method for all fees incurred in connection with your use of the Service.

5.3 Cancellation and refunds

You may cancel your subscription at any time. Cancellations will take effect at the end of your current billing period. You may request a refund within 30 days of the original purchase date by contacting us. Refunds are processed through Stripe and are subject to our refund policy.

5.4 Price changes

We reserve the right to modify subscription pricing with at least 30 days’ notice. Continued use of the Service after price changes constitutes acceptance of the new pricing.

6. Content and intellectual property

6.1 Your content

You retain ownership of content you create using Promoty. However, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and process your content solely to provide and improve the Service.

6.2 Our intellectual property

Promoty and its original content, features, and functionality are owned by us and protected by international copyright, trademark, and other intellectual property laws. You may not use our trademarks or branding without prior written consent.

6.3 Third-party content

You are responsible for ensuring you have the necessary rights and licenses for any third-party content you use with the Service, including but not limited to images, audio, and text.

7. User responsibilities

You are solely responsible for:

  • The content you create and publish using Promoty.
  • Compliance with applicable laws, including copyright and intellectual property laws.
  • Obtaining necessary rights, permissions, and licenses for your content.
  • Any consequences resulting from your use of the Service.

8. Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be uninterrupted, secure, or error-free.
  • The results obtained from using the Service will be accurate or reliable.
  • Any errors in the Service will be corrected.
  • The Service will meet your specific requirements.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LINKINTEL, INC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

  • Your use or inability to use the Service.
  • Any unauthorized access to or use of our servers or your personal information.
  • Any interruption or cessation of the Service.
  • Any bugs, viruses, or malicious code transmitted through the Service.
  • Any errors or omissions in any content.

Our total liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless Linkintel, Inc, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising from:

  • Your use of the Service.
  • Your violation of these Terms.
  • Your violation of any rights of another party.
  • Content you create or publish using the Service.

11. Termination

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without notice, for conduct that we believe:

  • Violates these Terms or our policies.
  • Is harmful to other users, us, or third parties.
  • Exposes us or others to liability.
  • Is fraudulent or involves illegal activity.

Upon termination, your right to use the Service will immediately cease. Provisions that by their nature should survive termination shall survive, including intellectual property rights, warranty disclaimers, and limitations of liability.

The Service may integrate with or provide links to third-party services, including but not limited to:

  • Payment processing: Stripe for secure payment processing.
  • Sign-in: Providers such as Google for account authentication.
  • AI services: Various AI service providers for content generation.

Your use of third-party services is governed by their respective terms and policies. We are not responsible for third-party services or their content.

14. Dispute resolution

14.1 Governing law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Linkintel, Inc operates, without regard to conflict of law principles.

14.2 Arbitration

Any dispute arising from these Terms or the Service shall be resolved through binding arbitration, except that either party may seek injunctive relief in court for intellectual property disputes.

14.3 Class action waiver

You agree to resolve disputes on an individual basis and waive the right to participate in class actions or class arbitrations.

15. General provisions

15.1 Entire agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Linkintel, Inc regarding the Service.

15.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

15.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

15.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.
